BenefitPersonas (“BP”) provides this Privacy Policy to describe its practices and commitments with respect to the personal information and/or data it may access, collect, process, store and use on its own behalf, and/or on behalf of its clients. The access, collection, storage and use of data, collectively, is referred to herein as “use” or “usage.” For purpose of this Policy, the terms “information” and “data” are used interchangeably.

Data Used by BP on Its Own Behalf

BP may collect data voluntarily provided by visitors to this website, through opt-in and registration forms. This information may include the individual’s name, past and/or current company name, type of business entity, the individual’s title, email address(es), phone number(s), the results of survey instruments offered on or through the site, and data regarding the pages, tools, resources, and information a visitor may access on this website. All data stored, transmitted or received by BP is encrypted. We may also store email correspondence and voice messages to preserve the history and continuity of our communications and relationships with visitors to and users of this website.

Methods of and Limitations on Use

Personal data is used by BP for sales and marketing purposes, including periodic email, text and voice communications. BP does not, and will never, sell, rent, lease, share or disclose personal information to any third parties, other than to companies providing services to BP in the context of such usage. All companies providing services to BP are under contractual obligations only to use such data lawfully, and to safeguard and maintain the privacy and confidentiality of all personal information received from BP, including prohibitions on selling or disclosing such personal information to any other third parties.

BP may disclose personal information if relevant laws so require, or if subpoenaed, or to otherwise comply with appropriate legal processes that may be served on BP by a third party, or to protect and defend BP's property and rights, this website, or other users of and visitors to this website.

Rights with Respect to BP’s Use of Personal Data

Any person who provides or has provided their personal information to BP via the use of this website may request in writing, by email to privacy@benefitpersonas.com, that BP (a) provide to such requestor the personal data BP has in its systems, (b) request that BP correct or update such data if believed to be incorrect or incomplete, and/or (d) cease using such data, and BP will honor such request(s). BP reserves the right to verify to its sole satisfaction the identity of anyone making such a request.

Data Used by BP on Behalf of Its Clients

BP works with businesses (“BP Clients” and “BP Vendors”) under contracts which are subject to stringent data privacy and confidentiality laws and practices. BP Clients and Vendors also work with other businesses, which are also subject to such data privacy and confidentiality laws and practices. BP Clients collect and use data on employees, and they may share certain personal data with BP, subject to relevant privacy and confidentiality laws. Such data typically includes names, home addresses, gender, and date of birth, and may include other employment-sourced data such as phone numbers, email addresses, job titles, etc. BP may enrich such data through its Vendors, and use such data to provide its Clients with enhanced communications, marketing, research and analytical services.

Protection, Confidentiality and Safeguarding of Data Used by BP on Behalf of Its Clients

BP’s Client and Vendor contracts include provisions that subject all such use by BP, its Clients and its Vendors to stringent legal, technical and administrative safeguards and constraints. Any and all such data used, stored, maintained and/or enriched by or for BP and its Clients and Vendors are further subject to contractual provisions that require BP to return, destroy, or cease using such data immediately upon a Client’s request or demand. BP is further subject to supporting any Client’s request to delete or update or correct any individual data that was provided to BP by its Clients. Any individual who believes that BP may possess or have stored their personal data on behalf of an BP Client, and wishes to invoke any associated rights they may have thereto, should initiate their inquiry or request through such BP Client, (i.e. their employer), and if such BP Client requests or instructs BP to process any such request or instruction under BP-Client contractual provisions, and BP actually has in its possession the referenced personal data, BP will comply with such request(s).

Updates to this Privacy Policy

BP may update this Privacy Policy from time to time, and its sole obligation to users of this website and/or with respect to data used by BP on behalf of its Clients will be to post on this website the date of such update to this Policy.
